Lexus Names Allowed in Domain Name

Since 2003, Toyota sued Lisa and Farzad Tabari, the owners of Fast Imports, in a Los Angeles federal court in 2003 stating that consumers would be confused by the use of the name Lexus in the defendant’s Web site domain name and the use of Lexus photos and the Lexus logo. The domain names are buy-a-lexus.com and buyorleaselexus.com. The federal court judge already ordered Tabaris to remove the term Lexus and the copyrighted Lexus photos and the Lexus logo from his websites.

However, Tabaris appealed their case. They might confuse the public if using domain names such as we-are-definitely-not-lexus.com and independent-lexus-broker.com. Chief Judge Alex Kozinski wrote: “When they say Lexus, they mean Lexus. We’ve long held that such use of the trademark is a fair use, namely nominative fair use. And fair use is, by definition, not infringement.” The panels also claimed that trademarks are part of our common language, everyone have some right to use them to communicate in truthful, nonmisleading ways. Finally, the U.S. Ninth Circuit Court of Appeals in San Francisco ruled that an authorized Lexus dealer can use the word “Lexus” in its Internet domain name.

Not long ago ICAAN announced that .xxx domain, which will cater to pornographic websites is approved; also, non-Latin characters can be used to register in domain names; Saudi Arabia, Egypt and the UAE are the first languages that accepted among the non-Latin characters. Recently, we also always heard about the news of Chinese domain names. At last, ICAAN give out the final confirmation to allow using Chinese character in domain names.

This decision will benefit all the Chinese-speaking Internet users and the Internet is about to become more accessible for around 1 billion users in the world. This figure is believed that will be increased more as Chinese learning already is a trend of this world. “Chinese learn pinyin, so they know how to write Chinese using Roman characters — every educated Chinese knows that ‘hulianwang’ for instance means Internet,”said Paul Denlinger, an Internet consultant specializing in the Chinese market. One of the intentions of making this decision is because Internationalized Domain Names (IDNs) found the majority of Internet content is in English almost 60% of users aren’t native English speakers.

ICANN approves China

There is a news that the new Chinese ccTLDs .中国 and .中國 (each meaning .China) already been approved by ICAAN and were managed by the Chinese registry CNNIC. However, people still do not clear how are these new ccTLDs going to be used since no further information from ICAAN or CINNIC. There is some rumors that .cn would be aliased to .中国. Regarding these rumors, CINNIC explained to public that .中国 would not be used as a separately registered competing ccTLD.

Meanwhile, the .cn ccTLD will be strengthened which would be coupled with .中国. The statement from the CNNIC service desk was: “Right now, when customers register chinese domain name with [the] .cn suffix, a chinese domain name with [the] .中国 suffix will be given to the customer for free. ” This action might help to recover the value of .cn which has been decline.

ICANN problems with whois

Not long ago some movie site such as TVShack.net, Movies-Links.TV, FilesPump.com, Now-Movies.com, etc had been seized by US Government because of cracking down on Internet piracy and counterfeiting. The US Government still continue their seizure action and now The Pirate Bay and MegaUpload domains are on the target list. However, domain seizures is not something new and over 140 domains related to online gambling had been seized by Governor of Kentucky since 2008.

The Internet Corporation for Assigned Names and Numbers (ICANN) is the body responsible for managing the web’s DNS system to ensure that users of the Internet can find websites by using domain names. However, there is a report from Internet policy and security research group KnujOn which released on last month show that a lot of Internet domain registrars (who sell domains to the public) could be violating their agreements with ICANN, including but not limited to the blocking of Whois information.
