Gamers will know what is Bioshock, it is a first-person shooter game that was announced in October 2004. Behind the scene, Take-Two Interactive is the main developer of the successful BioShock video game series. The game was released at two month before the domain name Bioshock.com was registered by Name Administration Inc, a Cayman Islands-based company that makes money from trading in and displaying adverts on its massive network of domain names.
Take-Two tried to protect the Bioshock trademark but the claim was filled with delay of a year after the domain name was registered. Because of this reason, Boishock.com does not serve as prior trade mark rights to the domain name and Take-Two lost the fight for Bioshock.com. According to an arbitration panel of the World Intellectual Property Organisation, Take-Two had failed to prove that the name was being used in bad faith. It wrote: “the Panel is not persuaded that the Respondent had in mind the Complainant’s trademark BIOSHOCK at the time of its registration of the Domain Name.”
And now they own a very expensive domain, very interesting.
